Appeal successful – controversial verdict against road rage driver overturned!

This verdict was a real shock, as can be seen from the three and a half thousand comments under the June 20 “Krone” report on the Wiener Landl trial. A 40-year-old driver who drove an activist off the road during a climate sticker campaign on January 11 has been sentenced to three months in prison for coercion and disrupting a meeting. On Tuesday, the Higher Regional Court overturned the conviction during the appeal hearing.

The video of the freak out, for which Mr. B. had to respond, was viewed 700,000 times on Twitter. The transporter, who was on his way to a promising appointment, jumped out of the car and attacked one of the demonstrators: “I told him to sneak away. But he always came back to the streets. I should have left it.”

Diversion option legally misclassified
The FPÖ did not wait long and provided the convicted carrier with legal advice. Successfully! The appeal process started on Tuesday at the Vienna High Court. After 15 minutes, the chairman of the jury announces the decision: the verdict against the anger leader is annulled. The matter needs to be renegotiated. “The possibility of distraction was legally incorrectly classified by the first court,” says lawyer Peter Skolek as the main reason for the OLG ruling.

There is no date yet for the second round
The convicted man, who lost his nerve in the morning traffic jam on the Vienna Belt, is relieved. Even last-generation violence victim Jacob Ranftl (29), who was grabbed by the hood of his sweater and dragged away by the father of the family, said at the time that he had nothing against a lesser sentence for his tormentor.

The renegotiations, for which there is no date yet, will determine whether this will happen. Viennese FPÖ leader Dominik Nepp is convinced: “A three-month suspended prison sentence for this action was scandalous. I am happy that we were able to help the man and that the verdict is over.”
