And that reforms as important as labor, pensions or various increases in the interprofessional minimum wage have been approved, among many other far-reaching measures such as the implementation of ERTEs and aid during the pandemic.

One of the great novelties of the new rule is that from 1 October it will be mandatory to contribute for unemployment and Fogasa (the social guarantee fund that provides compensation in the event of insolvency), both for the employer and for the employee, who will pay for both mean a greater tax effort. The new unemployment contribution will be 6.05% of the legal base, of which 5% will be paid by the employer (families) and 1.05% by the employee.

However, the government will reward families with 80% of this new contribution, yet those who have a full-time maid in the house will have to pay 12 euros more per month for this new allowance, an extra that comes close. up to 18 euros per month from January, when the new Intergenerational Equality Mechanism (MAY) comes into force to cope with the ‘baby boom’ of retirees in the coming years. This premium increase comes officially from Social Security, so that households do not have to do any paperwork.

The new rule will include a new table of sections of the premium bases based on salary, with the aim of making “jumping from one to another easier,” especially in the lowest, ministry sources explained to this paper. .

The Executive will maintain the current discounts and bonuses that now apply to employer households; everyone enjoys a 20% discount on the business contribution to the contribution for common contingencies, which can go up to 45% for large families. However, Díaz stated that within six months the number of beneficiaries with bonuses of more than 20% will increase as they have promised to publish a regulation in which the discounts will increase depending on the type of family, income level and heritage.

In addition, the Royal Decree also provides that employers assume the contributions obligations for employees who perform their services for less than 60 hours per month per employer, eliminating the possibility that the employees are the ones directly requesting their affiliation, registrations, cancellations and variations of data.

Domestic workers, for their part, will also pay a little more monthly fee, but will have access to “all the healthcare benefits available in the employment law system today” the moment they are given the right to do so. The first non-contributory unemployment benefits will be generated after one year, but after 90 or 180 days, depending on the age and family expenses of each worker, the entitlement to unemployment benefits can be generated by applying the general rule.

The other major novelty of the new law concerns the dismissal of these employees. Thus, the figure of withdrawal is eliminated, which allowed dismissal without any reason and for little money. Henceforth, the reasons for the termination of a contract must be proved and the ordinary severance arrangements will be applied to them, although there will be “some quirks” associated with the change in the needs of the family (for example, as the children grow) or changes in income or expenses (if either parent becomes unemployed.

On the other hand, the government will develop a training and accreditation policy for domestic workers dedicated to the care or attention of people who are part of the home and family environment. These initiatives will take into account the special working conditions in this sector and the employees who carry out their activities there.

The standard also establishes a commitment to establish a study committee with the aim of including the gender perspective in the table of diseases, so that the deficiencies that exist in the protection of women against occupational diseases are identified and corrected . Ladies.
