Preschoolers and primary school children are currently not allowed to go to their educational institution if they have tested positive for Covid-19. In principle, their parents may stay at home in this case, the legal basis for this are the provisions in the Employees’ Act and the General Civil Code, which also apply independently of Corona: On this basis, there is a right to free time if you are outside for serious personal reasons. your debt temporarily unable to work.

Anderl complained, however, that the specific duration of the exemption is not reflected in the law. Ultimately, this would have to be clarified in each individual case in court. “Especially in times of crisis, the workplace is not a place for labor law experiments.” The general rules on work absence are justified in normal times – but for the crisis mode the clearly defined special care time has been introduced. Until the pandemic is over, it must be enshrined as a permanent right.
