In fact, the judiciary does not care about insults as long as the person concerned does not worry about it. In the case of the Federal President it is different. Because FPÖ leader Herbert Kickl described him as “senile” and “mummy”, the prosecutor must investigate.
According to case law, someone who feels offended must order the judiciary to prosecute the alleged perpetrator. “It is different with high-ranking personalities,” explains Alois Ebner of the Ried prosecutor’s office. Herbert Kickl’s statements on the political Ash Wednesday of the FPÖ in Ried fall under their responsibility.
If a “high-ranking personality” is compromised, the judiciary must treat such statements as an “official offence”. In other words, she needs to take action.
For further steps, however, the person concerned, in this case the Federal President, who has been given the designations “senile” and “mummy from the Hofburg”, must give his consent. “It’s a violation of empowerment,” Ebner explains.
As is known, the Office for the Protection of the Constitution has already intervened and is investigating the verbal blunders.
