The Galdakao Provincial Council and Municipal Council are appealing against the denial of Usansolo’s registration as a municipality

The Provincial Council of Bizkaia and the Municipal Council of Galdakao have appealed to the High Court of Madrid against the refusal to register Usansolo as a municipality in the Register of Local Entities.

The new spokesperson of the Provincial Council of Vizcaya, Leixuri Arrizabalaga, stated on Thursday during a press conference after the board of directors of the provincial institution that the institution had filed a controversial-administrative appeal against that refusal on September 1.

In this appeal, the Regional Legal Services demand the adoption of a positive precautionary measure for Usansolo to be registered as a municipality, following the decoupling of this urban center from Galdakao.

The initiative is part of a joint strategy agreed between the Provincial Council, Galdakao Municipal Council and Usansolo Management Committee to finalize the final constitution of the latter enclave as the municipality 113 of Bizkaia.

In fact, the Municipal Council of Galdakao also appealed to the same court, which accepted the appeal, against the opposition of the Madrid Registry of Local Entities not to register Usansolo as a municipality, as the Management Committee had requested.

As indicated by the local institution on its website on Thursday, the regulations for the creation of municipalities are defined in the corresponding regional regulations and “during the process carried out in recent years, all the steps of said regulations have been complied with in detail.” .

According to the argument, the task of the Register of Local Entities is the registration of new municipalities, so “its function is not to review the agreements made by corresponding bodies, in this case the General Assemblies” of Bizkaia, with reference to the one adopted by the Chamber of Biscay on November 23, when it approved the deannexation of the town center of Usansolo from the Galdakao Municipal Council.

Furthermore, the spokesperson for the Provincial Council has reported that, in order to comply with this assignment from the General Assemblies, the provincial institute new management committee of Usansolo which results from the elections of May 28 and consists of eleven members, eight of which correspond to the Usansolo Herria Group, two to the PNV and one to EH Bildu.

The constituent session of the management committee, the seed of the future town hall, has been convened on October 5 in the hamlet of Txapelena in Usansolo and there the president will be elected.

In February, the Supreme Court of the Basque Country rejected the request by the Public Prosecutor’s Office for a precautionary suspension of the dissolution of Usansolo, while the appeal it filed against the creation of the new town hall continues because it does not meet the requirement. that the new municipalities have a minimum of 5,000 inhabitants, which is laid down in the Act on Basic Registers of the Local Regime, since Usansolo has 4,520 inhabitants.
