The case reached the Court of Guarantees after the Council of Ministers agreed on March 26 to file an appeal for unconstitutionality against the Popular Legislative Initiative that the Catalan Chamber board had admitted for consideration on February 2.
The Constitutional Court (TC) has unanimously agreed to hear the appeal filed by the Spanish government against the Parliament’s initiative calling for the declaration of the independence of Catalonia, which entails the preventive suspension of the measure .
Legal sources have confirmed that the court made this decision after almost an hour and a half intense debate. As they have indicated, although the measure has been agreed unanimouslyhas been discrepancies on the reasons for allowing the appeal.

According to the Minister of the Presidency, Justice and Relations with the Cortes, Felix BolañosDuring the press conference after that Council of Ministers, the Spanish government considered it relevant to challenge the initiative, as this “immediately” paralyzes its processing, since the Constitution provides that when the executive goes to the TC and the suspension of a provision demands, it is frozen, something that does not happen with the resources of the parliamentary groups.
The TC reported last week that the Spanish executive’s call had been added to the agenda of the plenary, which will meet next Tuesday, Wednesday and Thursday.
This morning magistrates accepted the government’s challenge to the proposal registered by Catalan solidarity for independence and it flourished thanks to the three votes in favor of the Junts and the CUP, the abstention of the ERC representative and the vote against the two members of the PSC in the governing body of Parliament.
