The Supreme Court (TS) agreed by majority on Tuesday: annul the appointment of Dolores Delgado as prosecutor of the Office of the Prosecutor for Human Rights and Democratic Memory and ordered that the Fiscal Council rule on whether or not it is compatible for it to assume the position as it is partner of former judge Baltasar Garzónwho runs a human rights foundation.
It made this decision when considering the pleas of the Association of Prosecutors (AF), the Professional and Independent Association of Prosecutors (APIF) and the anti-drug prosecutor Luis Ibáñez – candidate for the position – against the appointment of Delgado as head of Democratic memory.
This has been reported by the Supreme Court, which has advanced its ruling and will make public the ruling in the coming days, setting out the arguments on which it bases its decision. It is the second Supreme Court resolution to annul Delgado’s appointment, as his appointment as TS prosecutor was declared invalid last November.
As indicated by the court, this time the magistrates annulled the Royal Decree appointing Delgado and ordered that the procedure be carried out retroactively, so that the advisory body of the Public Prosecution Service can decide whether or not to comply with the prohibition of the article . 58.1 of the Organic Statute of the Public Prosecution Service (EOMF), regarding the compatibility of positions.
The court thus accepted the requests of the two associations and the anti-drug prosecutor, who demanded that the Supreme Court declare the nullity of this appointment and return the proceedings to the moment before Delgado’s appointment.
