The Freedom Youth plans to file a complaint with the Constitutional Court (VfGH) about the asylum law. The argument goes that “unconstitutional paragraphs” would violate the rights of children and young people. However, it is not about the rights of migrants, but about those of the Austrian population.
“Those who seek protection are now the ones our children need protection from,” Upper Austrian Deputy Governor Manfred Haimbuchner (FPÖ) said on Wednesday. Hundreds of violent crimes by migrants have been reported, with the victims mainly being Austrians.
The constitutional complaint therefore addresses the state’s obligations to protect children and young people, which are enshrined in the federal constitution. It is also based on the state’s obligations to protect people, which are enshrined in the European Charter of Fundamental Rights and the European Convention on Human Rights.
Migrants brought “violence, hatred and terror”
According to the FPÖ, the influx of migrants is uncontrolled and “violence, hatred and terror” have arrived. “De facto deportations” of those entitled to asylum and those entitled to subsidiary protection who have been legally convicted of a crime are not possible, Haimbuchner criticized.
The complaint will be submitted to the Constitutional Court (VfGH) on Thursday.
