The keys to the agreement between PSOE and PP for the extension of the CGPJ

These are the keys to this agreement, signed in Brussels by the Minister of the Presidency, Félix Bolaños, and the PP’s Deputy Secretary of Institutional Action, Esteban González Pons.

The PSOE and the PP have reached an agreement agreement for the renewal of the General Council for the Judiciary (CGPJ) which ends five years of interim status and which, according to the signatories, complies with the European Commission’s recommendations for the appointment of the governing body of judges and magistrates.

These are the keys to this agreement, which was signed on Tuesday in Brussels by the Minister of the Presidency, Felix Bolañoson behalf of the PSOE, and the PP Deputy Secretary for Institutional Action, Esteban González Ponswhich also includes an in-depth reform of the judiciary and the budgetary statute.

– PSOE and PP agree to immediately renew the agreement 20 members of the CGPJ.

– According to the socialists, the twenty elected have one “long history and proven prestige” in the field of Justice and Law and “with different sensitivities who represent Spanish society”.

– The PP, for its part, believes that the agreement guarantees an agreement “absolutely balanced from the CGPJ”which will have 20 new members “with proven track records and a solid educational background beyond any doubt.”

– In addition to the renewal of the CGPJ, the signatories will: reform of the Organic Law of the Judiciary and the Organic Statute of the Public Prosecution Service which the Socialists say will serve to “strengthen their independence, study possible reforms and put merit at the heart of making appointments.”

– For the Socialists, this new rule will require that appointments to senior judicial positions be made based on the merits and track record of the candidates.

– The law will also incompatibility regime of judges, magistrates and prosecutors in cases where they transfer from active service to the exercise of political positions.

– At the same time, the new CGPJ is in charge of the preparation reform proposals for the appointment of its judicial membersa proposal that will be sent to the government, Congress and Senate, where it must be approved by a large majority.

– This text, the PP assures, will have to explicitly contain a new model “direct participation” and voting so that judges can choose their representatives in the CGPJ.

– According to the popular people, the government will not be able to point it out chief justice, but it will be the new members of the Council who will choose the magistrate who will preside over the Supreme Court. They must elect him with at least twelve votes in favor and without candidates proposed by the political parties.

– Both the renewal of the CGPJ and the reform of the Organic Law of the Judiciary and the Organic Statute of the Public Prosecutor’s Office will be approved at the same plenary session of the Congress of Deputies in the month July.
