The Trump government first admitted that a man with a protected residence status was accidentally deported to El Salvador. Kilmar Abrego Garcia, who has been living in the United States since 2011, was brought to the dreaded “terrorism limitation center” in El Salvador despite a judicial protection status. His lawyer is now calling for his immediate withdrawal, but the US government refuses to bring him back to bring him back.
According to judicial documents that are “the Atlantic Ocean”, Abrego Garcia fled from El Salvador to the US at the age of 16 after he was threatened by gangs. In 2019 he received the status “disadvantage of removal”, namely to protect him against deportation. Nevertheless, he was arrested in Maryland on 12 March 2024 and deported only a few days later.
Woman recognized arrested on a photo
His family only learned about his deportation when his wife recognized him in a photo spread by El Salvador’s President Nayib Bukele. The photo shows him how it is led to the infamous high -protection prison “Cecot” with a lowered head of masked guards.
In a hearing on Monday, the government’s lawyers stated that deportation was due to an “administrative error”. According to the files, Abrego Garcia was not on the Hendel list in the first instance, but it was followed as a replacement candidate due to an internal incorrect estimate.
Despite the error, no returns planned
Despite the recognition of the error, the Trump government refuses to reduce it. The government spokesperson argued that American courts had no authority to issue such an order. “If that is true, the immigration laws are meaningless,” said Abrego Garcia’s lawyer: “The government could then make a deportation without interfering the courts.”
Gang allegations without proof
The Trump government defends the deportation and described Abrego Garcia as a “danger to the community” and alleged member of the MS-13 gang. However, the proof of this does not exist. The accusation goes back to a police check from 2019, in which Abrego Garcia and three other men were admitted to a parking lot of a hardware store in Maryland.
One of those present claimed that Garcia was a gang member, but did not provide proof. The police themselves did not confirm this claim and no charges were filed against Abrego Garcia. Nevertheless, he was transferred to a deportation procedure.
Family in concern, political debate escalated
Abrego Garcia leaves his wife and five -year -old son in the United States, who suffers from autism and cannot speak. He worked like a paint locksmith and had never become a criminal offense. His family has not had contact with him since his deportation.
The American vice-president JD Vance defended the measure and publicly claimed that Garcia was a “convicted gang member”-a demonstrably wrong claim.
Instruction was ignored
The case causes violent debates in the US. A federal judge had stopped the deportation flights to El Salvador shortly before the deportation of Garcia, but the instruction was ignored. Critics accuse the Trump administration of the undermining of case law and randomly deporting people with legal protection status.
