An American judge is currently causing a stir. With a verdict, he dedicated the government of President Donald Trump to record and complain 12,000 refugees, the Republican simply inverted instructions.
With his opinion, district judge Jamal Whitehead made clear the decision of a court of appeal from March to Monday: according to this, the US government can suspend the recording program for refugees, but it must continue to accept refugees with already planned access to the US.
Until the end, admission as a refugee was one of the few legal ways for US citizenship. Trump’s predecessor, US President Joe Biden, had expanded the competence criteria with people who flee for the effects of climate change.
The US government had stated in advance that only 160 refugees who had planned an entry within two weeks after his hoarse in January. Whitehead accused the government of Trump to interpret the judgment of the Court of Appeal according to their ideas.
“Results – -oriented creation of a judicial order”
In order to come to the same conclusion as the government, “not only a lecture between the lines is” needed, but a “getting-of-hallucination of a new text that simply is not there,” it said in his judgment. If the Court of Appeal wanted to reduce the refugees to 160, it would have done explicitly, the judge said. The court will “not accept the result -oriented diversion of a judicial order that clearly says what it says”.
Whitehead had blocked the US government’s decree, which suspended the recording program in February, but was arranged by the Court of Appeal. Various organizations of the American human rights had previously sued the decree.
