How can CSD assure players that they will not be penalized?

National team players will negotiate with the CSD and Victor Francos a written document promising that they will not be penalized if they opt out. The current Sports Law clarifies that: “Go to the calls of sports teams when they are duly summoned, under the terms and conditions established by regulation.”

The same qualified as a very serious violation “the unjustified lack of attendance at the calls of the national sports teams, as well as the failure to provide the national teams with the athletes designated to be part of them” . Among other penalties, this can lead to the suspension of the federation’s license for between two and 15 years, preventing an athlete from competing for their club.

Since the disciplinary regime has not been developed, the Royal Decree of 1992 on Sports Discipline remains in force, which classifies non-participation in the national team as very serious and establishes a penalty of two to five years:

“Disqualification from holding positions in sports organizations, or suspension or removal of the federative license or equivalent qualification of state-level club groups, on a temporary basis for a period of two to five years, in appropriate proportion to the offense committed.”

At the same time are the regulations of the Spanish Football Federation where in its Disciplinary Code where it mentions harsh punishments in case of not being able to attend the call of the national team. In its article 65, it is clearly stated that “Football players who, without justification, do not attend or leave the calls of the National Teams, understood as referring to training, concentration, or effective celebration of matches or competition, shall be punished with a fine of 3,006 to 30,051 euros and with one or more of the following penalties:

– Disqualification from holding positions in the federative organization, or suspension or removal of license, for two to five years.

– Removal of license, certain; “This type of punishment can only be imposed exceptionally for repeated offenses of very serious offences.”

Then, for the CSD to promise no sanctions, everything happens because the RFEF does not criticize the internationals for their abandonment of the concentration. Since there is no complaint, there is no further reason for punishment. Because once there was one, it would go through the first instance judge, appeal to the Appellate Division and reach the TAD. And, although the latter depends on the CSD, it is independent and must punish players for abandoning concentration.
