This Thursday, the RFEF Board of Directors met, the first after TAD’s notification of Pedro Rocha’s disqualification on Tuesday for the next two years. The Board is chaired by the first vice president María Ángeles García Chaves, in the absence of the president of the federation himself.
In the meeting there was no agreement regarding the path to follow after the TAD ruling because in the meeting all members were informed that this Thursday the lawyers of Pedro Rocha are presenting a request for precautionary measures before the Administrative Litigation .
Pedro Rocha informed the Secretary General so that the disqualification would not be effective. As we already explained in MD, it was not the TAD but the Sports Federation that executed the disqualification.
Now, therefore, it depends on the decision adopted by the ordinary justice system in the coming days to know what will happen in the future of the RFEF.
Pedro Rocha may be in the Assembly on July 30
If the precautionary measures are finally upheld, Pedro Rocha could continue to lead the Spanish Federation until a final decision is made. Solving the sentence can take up to a year. This situation may allow Rocha to attend the General Assembly scheduled for July 30.
At the Assembly, the accounts of the RFEF as at June 30 were presented to the Board. In addition, Pedro Rocha can run in the elections scheduled to be called starting in September for the 2024-2028 cycle for the presidency, Assembly and Delegate Commission.
If the precautionary measures are rejected, two scenarios open up
On the one hand, the RFEF Statutes establish that this Board should be constituted as a Management Commission to appoint a new president under the current General Assembly. Said President will be in charge of calling elections in September for the 2024-2028 cycle.
And then there is the Royal Decree that regulates the electoral processes in Sports Federations where it stipulates that this obligation to appoint a new president in case of disqualification is when there are six months or more left for the next electoral process .
But in this case, only two months are left. This will open the door for the current RFEF Board to stay on until September for elections to all bodies. Therefore, no agreement was reached pending the decision of the administrative litigation.
