Victims of traffic accidents feel discriminated against by the government towards insurers

Date:

They express their indignation because as of July 1, 2022, the update of the actuarial technical foundations of the car scale has not yet been published

Lawyers for accident victims have sent a letter to the Minister of Economy, Nadia Calviño, expressing their outrage that the update of the actuarial technical foundations of the weighbridge has not yet been published as of July 1, 2022. The ANAVAR-RC Association, the National Association of Lawyers for Accident Victims and Civil Liability, along with the associations ADEVI and ADAVIAC, believe that this document is vital for critically injured persons as it helps to calculate compensation to be referred to calculations is deducted. actuarial matters such as the help of a third person or the health care costs that will be needed in the future, depending on the life of the victim.

This document is “essential to them” because it contains the calculation of the actuarial bases used to value the damage caused in traffic accidents. This deducts your annuity, the help of a third party or the healthcare costs that you will need in the future, depending on the life years that the injured person has left, they explain from ANAVA-RC.

This delay is added to the delay in scaling according to the reasoned report of the monitoring commission which has been public for more than a year and which has also not been implemented, so that they feel discriminated against in insurance from this group businesses.

These tables are linked to the Interprofessional Minimum Wage, which is now 50% higher than when they were created. It has gone from 600 euros per month to the current 1,000 euros. “This government, of a progressive nature, promised through the DGS to update it, but does not attach much importance to it. So much so that, according to insurance industry sources, the new technical bases represent an increase in reimbursements of almost 90 million euros. Because it has not come into effect since January 1, 2022, insurance companies have delivered about 45 million in savings and delays another 7.5 million each month that are held back by injured people with serious consequences,” he says. Manuel Castellanos, president of ANAVA-RC .

Said project has been completed in the Ministry of Ms. Calviño since December 2021 and it was said that it would be delayed by six months to adjust the increases that this government has made with very good judgment to the minimum interprofessional salary and the increase of the pensions , but what It is true that this important update will go ahead without the consequent damage to the victims of traffic accidents.

For the lawyers “this situation is beyond scandalous and we are urging the government to update the technical foundations that should have been implemented 3 years after the publication of the 2015 law and it has not happened. Then they assured that they would take place after 5 years maximum and 6 have passed and they have not updated either. They were finally finalized in 2021 in the Monitoring Committee with the agreement of all parties to come into force on 1 January and we are still not publishing anything. Subsequently, the DGS announced that it would be delayed by 6 months with the entry into force on July 1, and we are still waiting for this. We believe that this is already a joke for citizens and especially for victims of accidents with serious consequences. With this surprising delay, it is the insurance companies who are once again benefiting to the detriment of the victims,” continues Castellanos.

According to Castellanos, the government “does not seem to understand that despite the fact that these victims are the fewest in our country and represent a small percentage of the total number of car accidents, it makes perfect sense, especially for them, that the protection system be updated, compensation and solidarity demanded from Europe culminating in the last reform of the system with Law 35/2015».

Added to this, according to the complaint, is that the law itself which published the new scale laid down in the second additional provision, that the Directorate General of Insurance and Pension Funds will, where necessary, promote the amendments it deems appropriate, after it has been published since more than a year a reasoned report prepared by the Committee of Experts with substantial improvements in the scale, including fifty in which the victims and the insurance sector agree, benefit the injured in accidents and which have not been carried out due to the laziness of the administration.
