Trial for infidelity – distraction: fine for ÖVP federal councilor Himmer

Date:

That ÖVP politicians and ex-Alcatal general Harald Himmer and ex-Telekom boss Rudolf Fischer are in the dock of the Viennese regional court is “thanks” to lobbyist Peter Hochegger. As in the Buwog/Grasser trial, he pleaded guilty to the alleged breach of trust. Both the public prosecutor and especially Himmer’s lawyer, Rüdiger Schender, want to know more about the how and why. The procedure ended in a distraction.

And this is where Hochegger needs an explanation. He always tries to make it clear that his confession mainly concerns the “not valuable” studies (for which Alcatel had paid some 240,000 euros to Hochegger’s company “Valora”) – which he himself valued at “approximately 5,000 to 10,000 euros”. ”.

Judge Hohenecker also wants to know – based on a ruling from the Buwog investigation – where and what the service was. Hochegger simply refers to his confession. Ms. Rat digs deeper: “What about cash payments in envelopes? “

Also Marilyn Monroe picture in the game
Since Hochegger is more precise, “Himmer said the three of us share one study.” He had listed this under BMF (alliance with Fischer): 19,000 euros for Himmer, 12,000 for Fischer – and a picture of Marilyn Monroe of a Warhol student in his style around 7,000 euros.

The former Telekom boss saw this as a present for his 55th birthday, which coincided with his departure from Telekom. And as a housewarming gift for his house in Styria – which Fischer never really moved into in the end. Today he lives with his young wife and small child as a pensioner in Thailand …

The judge smiling: “But the other two are refusing exactly these payments!”

“I had no influence on that”
And yet it would have been so: Hochegger was a lobbyist for Huawei – the Chinese company penetrated the Austrian telecommunications market through price dumping and caused difficulties not only for Alcatal, but also for Siemens – and at the same time would help competitor Alcatel? Or – as prosecutor Bernhard Löw puts it: “Were you paid to curtail your work for Huawei?” Hochegger confirms this hesitantly: “Himmer told me that his company wanted 50 percent of the order volume of around 60 million euros.” “But I could not influence that, the client is Telekom and not me.”

The otherwise moderate Rudolf Fischer loses his composure a bit: “He should have taken ten or 19,000 euros? He’s not an absolute idiot, he stood behind his company, where he was for 15 years and worked his way up to a management position. He doesn’t jeopardize that.”

In his opening speech, prosecutor Bernhard Löw did not just slide down a slide, but down a highway to Harald Himmer, ÖVP federal councilor and ex-Alcatal boss, who is on trial for infidelity in Vienna: When he “assumed responsibility , something went wrong here he proposes a diversionary maneuver against a fine or social benefits. “The whole thing” was 15 years ago, the sentence is 3 years. In the case of the other two defendants – lobbyist Peter Hochegger and ex-Telekom General Rudolf Fischer – could he have imagined not imposing an additional sentence Both have been convicted – in some cases not legally binding.

Himmer took responsibility
And after the lunch break it was time. Harald Himmer, once a young hopeful of the ÖVP with pithy statements “Torment bigwigs, choose Himmer” took over for two studies that, according to Hochegger’s expert opinion and confession, are worth “maybe 10,000” euros, but for which Alcatel paid more than had transferred 200,000 euros to Hochegger’s company “Valora”, “Responsibility. From today’s point of view, these payments have unfortunately been made. It should have been handled or instructed much more precisely.”

For example, 5 days of trial and witness summons expire. In the afternoon the verdict fell: Himmer was sentenced to a fine of 11,500 euros. When he said “goodbye” to the judge, she replied, “No, not goodbye. Because then the trial would be revived.”
