With the decision of the Vöcklabruck district administration, a couple who owned a Chow-Chow bitch was permanently banned from keeping dogs. The dog owners had repeatedly kicked their own bitch as she was pinned to the ground. The incident was filmed by an animal rights activist and the video was sent to authorities. The bitch was immediately taken away by the authorities and a permanent ban on keeping dogs was imposed. But the couple sued the ban on keeping dogs, but sued at the Upper Austrian Regional Administrative Court.
The dog owners filed a complaint with the state administrative court. They claimed the incident was caused by the dog wanting to run into the street and that she had been behaving unusually. The dog owners were bitten while restraining the dog, then turned her onto her back to calm her down. That was why they overreacted a bit.
The criminal case ended in diversion
The criminal case against the two dog owners was dropped after the main hearing by the regional court in Wels with a probationary period of two years.
On the basis of the court documents and the oral hearing, the administrative court of the Land concluded that the complaints should be dismissed and that a permanent ban on keeping dogs should be confirmed. The justification stands alone.
Fever and infection as a result
Chow Chow dogs have a strong hunting instinct, because of their breed characteristics they find it difficult to bond with people and do not handle discipline well. It was noted that the dog’s owners repeatedly brutally and aggressively kicked the bitch’s head and body as she was forcibly turned onto her back. The animal was inflicted several painful hematomas; fever and a non-specific infection were also found. The dog owners did not visit the vet until several days after the official approval, although the dog must have been in severe pain.
Basic knowledge of dogs is generally lacking
The behavior of the dog owner and her partner must be classed as particularly brutal, suggesting even in the case of a one-off incident that there is a lack of basic knowledge of the particular dog breed as well as dogs in general. The fact that the owners have repeatedly influenced the bitch shows tremendous indifference to animal welfare and a real disinterest in the animal’s health. The same applies to the fact that no veterinarian was consulted after the incident.
Stopping was not appropriate
The imposition of a permanent dog ownership ban on the complainants was therefore appropriate and necessary.
