“The crime plan was doomed from the start,” all three of the defendant’s lawyers agree. What this exact crime plan turned out to be is a matter of zealous debate in court. While the first 21-year-old accused passes the – unsuccessful – plan to his second accused comrade, he claims to have only noticed the project in the parking lot of the Spar branch: “There was never any question of him setting fire to anything. I wouldn’t have taken part in such a thing!”
Car doused with gasoline and set on fire
The fact is that the 21-year-old drove the car of an acquaintance in the early morning hours on October 22, 2022 without braking through the window of the supermarket on Jedleseer Straße: “The plan was that I against the ATM”, which he missed. They allegedly doused the car with gasoline to cover their tracks and then set it on fire. A surveillance video shows how the second suspect fills a jerry can with exactly this fuel at a gas station. Nevertheless, the 22-year-old remains responsible: although he would have been involved in the attempted burglary and also in the arson, this plan would not have been his. This is the view of the 21-year-old first defendant, who has already provided a wide variety of versions in the course of the proceedings. His explanation: “If he can make up a story, so can I.” By this he means his buddy, as they would have agreed: “Whatever happens, everyone is to blame.”
Little remains of the former friendship in the courtroom. Time and time again, the 22-year-old shook his head incredulously as the judge summarized the statements – the youngest was questioned separately.
The third of the group drove the getaway car
Another 22-year-old who had little to do with the two young men is also accused. He is also the only one on the loose and did not have to be held in custody. The first suspect was his dealer, he wanted to buy cannabis from him. All he had to do was take the 21-year-old from A to B. He would have been in the Spar branch. According to the indictment, he did drive the getaway car, but said he had no knowledge of the clumsy break-in.
Three years in prison for ‘mastermind’ of the failed plan
A few hours later, the first and second defendants even returned to the burning supermarket. One would have wanted to see what finally happened. They caused more than two million euros in damage. What they must now face: Three years of non-binding prison is imposed for attempted burglary, arson and drug offenses for the 21-year-old – the judge describes him as the “mastermind” of this act.
His second accused buddy has 18 months for his contribution to the burglary, 12 of which are in prison. When in doubt, the jury acquitted him of arson. The third young man is sentenced to a fully suspended sentence – his contribution to the burglary would be the smallest…
