Weapon of terror in Vienna – judicial errors: the procedure was set by mistake

Date:

In connection with the terrorist attack in Vienna, which killed four passers-by on November 2, 2020, the alleged arms supplier must answer in court on Tuesday. He benefits from a mistake by the Vienna public prosecutor.

Due to the termination of a procedure in 2021, Marsel O. can no longer be held responsible for handing over the assault rifle used in the attack to the later assassin.

“We’re sorry”
The spokeswoman for the Vienna Public Prosecutor’s Office, Nina Bussek, admitted the error on Saturday afternoon. “We’re sorry,” she stated. However, one is “legally bound” to the wrongful termination of the procedure at the time. The error should have been noticed by the judiciary just days before the main hearing.

The decision of the competent court, according to which the Zastava M70 assault rifle – a model manufactured in the former Yugoslavia based on the technology of the Kalashnikov AK-47 assault rifle – is no longer the subject of the case, is dated May 26.

Must answer for Tokarev brand gun only
Marsel O. only has to answer for a Tokarev handgun delivered on September 25, 2020, a few weeks before the attack, which he allegedly turned over to the later hitman and business intermediary, Adam M., in federal capital . The killer was shot by the police during the attack in the center of Vienna.

Adam M. was sentenced to life imprisonment by the Vienna Regional Court last February for his involvement in the acquisition of weapons and for his contribution to four murders and several attempted murders. He is only charged with violations of the Weapons Act, participation in or complicity in the act of terrorism is not charged. The public prosecutor does not assume any involvement in the murder. Marsel O. faces up to two years in prison if convicted in accordance with the prosecution.
