But they know each other on Facebook and kept in touch while the 31-year-old was in prison. After her release in early December 2022, they met in person. “Yes, it was an affair,” the alleged victim had to admit in court.
Submitted messages turn the process around
An affair that should soon come to an end. When the 31-year-old’s partner, who was also in prison, was released in early January, she summarily reported to the police a few months later for stalking.
There was still contact from both sides. This is evident from pages and pages of messages and telephone calls from lawyer Musliu during the trial in favor of his client. They are “chatlogs with kisses and red hearts”, even after the release of the 31-year-old’s partner.
She even wrote a message to the Viennese with the words “I love you very much” – in the accused period. “What is that supposed to mean?” defender Mirsad Musliu confronted the prosecution. Who has to admit: “I’m not saying I didn’t want the contact. Not until my boyfriend found out about the affair, not anymore”
“But then we are in the wrong place in the criminal court”
All she wanted was for the prison officer to leave her alone – now that her boyfriend has been released from prison and knows about the affair. But neither fear nor restrictions on her personal life were ever a problem for the ex-con. “Then we are wrong at the criminal court”, the judge sighs.
Smooth acquittal for civil servants in love
Lawyer Mirsad Musliu at the end of the hearing: “I don’t often do that in court. But today I have to demand an outright acquittal.” That happened a little later.
The reason: the facts of persistent pursuit – ie stalking – are simply not fulfilled. So the affair between the former inmate and the prison guard ends with a restraining order…
