Mother remains anonymous – court dismisses lawsuit against adopted French woman

A French woman who was adopted as a baby and tried unsuccessfully to discover the identity of her birth mother has failed in her case at the European Court of Human Rights. France has found a compromise “between the right of the accuser to know her origins and the rights and interests of the biological mother, who wishes to remain anonymous,” according to the reasons for the verdict published in Strasbourg on Tuesday.

The plaintiff’s right to private life has therefore not been violated. The woman was adopted shortly after birth in 1952, but only found out after her adoptive parents died in 2008. She contacted the relevant French authorities, who were able to locate her biological parents. However, neither of them wanted to come into contact with their daughter.

Mother was under pressure from her fiancé
The French woman only found out about the circumstances of her adoption: her biological mother was under pressure from her fiancé, who only wanted to marry her if she divorced the child. Since 2002, France has had an authority that, on the one hand, helps adopted children find their biological parents, but on the other hand respects their possible desire for anonymity.
