The tragedy of the jogger from Naarn (Upper Austria) who was bitten to death shocked the whole of Austria, but the defendant does not accept her guilt: it has now become known that the Linz public prosecutor has charged the owner of the three dogs mentioned with murder by gross negligence . The trial will take place on March 7.
“The Public Prosecution Service assumes that the suspect was traveling with three dogs and was overwhelmed. A dog caused her to fall by running from left to right. All three dogs then attacked the jogger together. The owner was unable, physically or with commands, to withdraw her dogs from the victim in time. That is why we accuse you of murder by gross negligence,” explains Ulrike Breiteneder, spokeswoman for the Linz public prosecutor’s office.
“I didn’t do anything wrong”
Frightening and astonishing at the same time: the suspect admits that she fell because a dog – it was the American Staffordshire terrier ‘Elmo’ – dropped her, but she only then saw that the three dogs were with the jogger she had, nothing wrong done.
In any case, the dog owner will have to appear in the Linz regional court on March 7. The penalty is a maximum of three years.
The tragedy occurred on October 2
On October 2, Herta A. was attacked by an American Staffordshire terrier while jogging. The owner brought the animal and two others from the breeding farm, but could not prevent the sudden attack on the athlete and was injured himself. It now appears that all three animals may have attacked the 60-year-old, who appeared to have come running from behind along a dirt road. The autopsy revealed that the woman had died due to excessive blood loss from numerous bites.
The terrible incident also sparked a national discussion about keeping fighting dogs.
