A knife attack in the neck on an alcohol-soaked December night landed a Lungauer (55) in a prison cell. But now the Salzburg judiciary has lifted the pre-trial detention and released the local man. “Because an accident cannot be ruled out,” lawyer Kurt Jelinek emphasizes in the “Krone” interview.
The suspect is also said to have saved lives
The lawyer had sent a request for release to the Salzburg Regional Court: he demanded the release of his client. Reason: The bloody incident on December 2 could also have been an accident, Jelinek stated in the application, referring to the forensic pathologist. According to their report, it is not clear whether it was a stab or a cut. In addition, the suspect probably saved the victim’s life by providing first aid. The Public Prosecution Service, on the other hand, demanded continuation of pre-trial detention, because the fact essentially entailed a threat to life – and therefore a possible suspicion of attempted murder.
The judge followed the lawyer’s request
However, the judge followed the lawyer’s legal advice and released the Lungauer in exchange for milder measures. He must therefore abstain from alcohol, have it checked daily by the police and refrain from contact with the victim – a local resident (37).
It is unclear how the knife attack in the neck area came about: both the alleged perpetrator and the victim were very drunk – with a blood alcohol level between 2.3 and 3. Both spoke of gaps in their memories.
