The 70-year-old pensioner from the Hausruckviertel was accused last year by his then twelve-year-old granddaughter of touching her intimate area and performing sexual acts with her.
Everything denied
The defendant denied all allegations in court and insisted that no sexual contact had ever taken place between the two. Only once, when the twelve-year-old next to him was doing gymnastics on the bench, did he see her genitals. “She was bored watching TV, and when she did a handstand for me, I suddenly saw her private parts,” the grandfather said, and nothing more happened. Another time the girl grabbed his hand and pulled it between her legs, to which he responded forcefully and tried to pull his hand away.
Difficult circumstances
His granddaughter was placed in a residential group for difficult children and young people because she was not in good hands at home; her father, the suspect’s son, had printed out poster-sized nude photos of his 14-year-old niece and hung them in his hometown, for which he was also convicted and has been undergoing treatment ever since.
False confidence
The grandparents, on the other hand, have often visited the granddaughter since the incident, made long trips with her and enjoyed the full trust of the institution. She also often visited her grandparents at home and enjoyed watching movies or playing cards with her grandfather.
Granddaughter traumatized
The mother described the suspicious incident very differently: The daughter then returned home and locked herself in the toilet for a long time until she finally came out and wrote on a piece of paper and sketched how and where her grandfather had touched her.

The judge and jury ultimately decided that the grandfather was not as innocent as he had been led to believe. The verdict: 30 months in prison for the 70-year-old, ten of which are unconditional. The verdict is not yet final; the public prosecutor and defense made no statement.
