An 18-year-old Afghan man had a forbidden relationship with a girl of only twelve years old. The two also had sexual intercourse with each other. He was sentenced on Friday by the Feldkirch Regional Court.
“Even though it was a romantic relationship between you and the girl. The fact is that the victim was only twelve years old at the time and the sex was therefore punishable,” said chairperson Sabrina Tagwercher about the suspect.
About the case: Two years ago, the then 16-year-old Afghan met the 12-year-old via Snapchat. Shortly afterwards the two become a couple. What the student’s parents do not know is that their daughter has a sexual relationship with the boy and that he secretly visits her at night for their little pastoral hours together.
Child confided in mother
When the relationship ended after just four months, it had major consequences: the girl started cutting herself. But even after the mother first talks about it to her child, it takes almost a year before the student breaks her silence and talks about the sexual relationship with the Afghan. It is displayed.
Imprisonment and fine for 18 year olds
The victim and perpetrator claim to have had consensual sexual intercourse. But according to the law, the boy is guilty of serious sexual abuse of a minor. Judge Sabrina Tagwercher found the now 18-year-old guilty of the charges and sentenced him to a suspended prison sentence of nine months. He must also pay a fine of 1,440 euros. Mrs. Rat awards the victim compensation of 2,000 euros. He must pay it within two weeks.
The 18-year-old got away with the sentence: according to the law, he could have been jailed for a maximum of five years.
