Chats, photos, private data – new law: when can the police have your mobile phone?

Date:

In 2025, the current regulations for the security of mobile phones will have to be renewed. Otherwise, the police and the Public Prosecution Service have the right to confiscate mobile phones without strong suspicion. Anyone who has kept ID cards, documents, credit cards and private documents is simply out of luck.

The legal system is currently doing well. As reported, the planned amendment to the law on the protection of mobile phones is causing a stir and a new coalition dispute. The decisive factor in the discussion as to whether a mobile phone falls under the confidentiality of correspondence was a ruling by the Constitutional Court – following a complaint by a manager from Carinthia who did not want to tolerate the intrusion into his private life.
