30 months partially suspended – Why a dispute over a can of coke ended in a long prison sentence

It was not expected that the 33-year-old immediately accepted what seemed like a severe punishment and had to spend almost a year in jail because of a fight over a can of Coke. But he already knew that he was not a blank slate and that one more “little thing” would make the punishment more severe.

The relationship with his landlord was clearly not the best and on July 27 this year the late night trip to the fridge was the last straw.

Night terror
The 33-year-old, who lived in a separate apartment in the victim’s home, grabbed a can of drink from the refrigerator at 1:15 a.m. and startled the landlord, who was still in the living room. When the landlord said out loud that he didn’t want that, the 33-year-old went crazy.

Escape from home
He punched and kicked the victim, then grabbed a baseball bat and used it against his landlord, who escaped the house with injuries: a cut to the head, an abrasion to the elbow and bruises to his back.

Material damage made from ‘weed fat’
During the trial at the Wels Regional Court, the 33-year-old had to answer not only for intentionally causing serious bodily harm, but also for damaging property. And because of that “the herb became fat”. Because the suspect had previously been convicted of property crimes and these were considered ‘relevant’ at the time. And although it was the first crime, it carried a strict penalty: 30 months in prison, of which ten months were “severe” – up to ten years would have been possible. It is already legally binding.
