Transpersons do not have to detect any gender -accumulating operation to change their gender entry. The European Court of Justice (ECJ) has now decided. It is an individual right to correct personal information.
In this case it was about a refugee person from Iran who received the protection of Hungary for transidentity. The ECJ reported that the refugee should show psychiatric and gynecological certificates. Accordingly, the person was born as a woman, but had a male gender identity.
The authority led the person as a woman and refused to change the entry. The reason: after all, there was no gender operation. The person then moved to the court that referred to the European Court of Justice.
The Hungarian court pointed out that there was no national regulations for acknowledging transidentity. The ECJ came to the conclusion that this should not be an explanation to refuse to correct personal data. Transmensen or transgender are people who do not belong to their biological gender.
