Travel agencies are inaugurating the new ERTE, a red mechanism created as part of labor reform. The Council of Ministers on Tuesday approved the activation of an event for this sector, which may be requested from 1 April to 31 December 2022 and which may last, in principle, one year. The files include a 40% contribution on social security contributions that companies pay to their staff before they offer training plans for workers.
The red mechanism is a new type of ERTE created by labor reform, cyclical crises in the economy, or sectoral crises. This should be activated by the Council of Ministers, a step the government took this Tuesday and from there companies can request if they meet the set requirements.
Travel agencies are still badly affected by the pandemic crisis, with 25% of their subsidiaries in ERTE, and for the economy as a whole this figure is much lower, “below 5”, the Ministry of Labor emphasizes. 40% savings on social security contributions
In particular, the activation of the RED mechanism for the travel agency sector will enable companies whose activities are classified under the following CNAE-2009 codes: 7911 (activities of travel agencies), 7912 (activities of tour operators) and 7990 (other booking services and related activities) as of March 31, 2022.
Companies can request the use of measures to temporarily reduce the working day or suspend employment contracts from April 1 until the end of the year. These files have “an initial maximum duration of one year and the possibility of two extensions per six months,” the government recalls.
The procedure will be initiated “at the request of the company to the competent labor authority and simultaneous communication on behalf of the employees”, collects the statute of the employees (Article 47 bis).
Defending companies must submit a retraining plan with training to transfer employees to the same company or to other companies in a different position. “Companies will be exempt from 40% of their employees’ contributions to social security,” the executive recalled.
Travel agencies celebrate the event
“We are celebrating the approval of the RED mechanism, it is the best protection system for both companies and workers,” said Carlos Garrido, President of the Confederation of Spanish Travel Agencies (CEAV), after its approval by the Council of Ministers.
“The ability to use these new ERTEs, which are part of labor reform, is the best way to protect the business fabric, which is mainly made up of small and medium-sized businesses,” he added. More than 30% of the travel agency’s staff is subject to ERTE, due to the mobility crisis caused by the pandemic, which is now compounded by the conflict in Ukraine.
