As is known, Vorarlberg is a very expensive plaster, which is not least applicable to apartments. The Labor Chamber (AK) Vorarlberg wants to change that now – including a ban on temporary lease contracts. The “Kroon” knows the details.

In Vorarlberg lives more than every fifth household household in private or commercial rent. As a rule, these are the rent in which the rent can be freely agreed, and there is usually a link with the consumer price index. In this living segment, people’s need is greatest.

This is also confirmed by the results of a living study conducted this year by the AK Vorarlberg: according to this, more than 70 percent of the tenants stated that their rent had been adapted to the index at least once in the previous year. In the case of a third party, the rent was increased in the course of an extension of the lease.

Expensive contract extensions
And that is precisely the core of a time limit: with every contract extension the rent can also be reconciled via the consumer price index. As a result, the rents in Vorarlberg have risen considerably above inflation since 2012. The Chamber of Labor has long been drumed for a fair regulation.

Railwind recently received these efforts from the Austrian Constitutional Court: this has confirmed that tenants can rely on the Consumer Protection Act compared to commercial landlords. And this says that agreements are illegal if they allow the entrepreneurs to increase the price for their performance within two months of the contract of the contract.

Fear of an overview
In theory, the tenants involved could now observe their rights and reclaim the money that paid too much. AK -President Bernhard Heinzle, however, doubts that this will happen: “The approaching loss of apartment or relocation, which would be associated with great efforts and high costs, will prevent much of the claims of their claims.” In short: you don’t dare.

It is all the more important to finally break with this unfair practice and to put an end to the time limit for commercial lease contracts. If the AK expires, the rental prices may only be adjusted once a year and the increase must be covered by two percent. In addition, a retrospective rent increase from the law must be excluded for all rental relationships of homes. These transitional regulations must apply until they become viable due to a large reform of the rental legislation – “it’s long too late,” Heinzle said.
