The Spanish Interior Ministry has been ordered to pay €100,000 in damages to Aingeru Zudaire, a resident of Villava who lost an eye after being hit by a ball. The Supreme Court partially upheld the victim’s appeal.
Zudaire was given a ball by the Spanish National Police during the general strike mobilizations called for by the trade union majority in September 2012, and lost an eye from the serious injuries he sustained.
The Provincial Court of Navarra in 2019 acquitted the police officer accused of throwing the rubber ball on the understanding that he was not proven to be the author, but admitted that Zudaire lost his eye for that reason.
That second part has been the one that made it possible to appeal to the National Supreme Court and ensure that the Ministry of the Interior has to reimburse the victim 100,000 euros.
