The text will be registered in Congress “in the coming hours” with the aim of being processed through the emergency procedure.
The bill to grant amnesty to the Catalan independence movement covers 11 years processesfrom January 1, 2012 – through the consultation of November 9, 2014, the illegal referendum of October 1, 2017 and the riots after the 2019 ruling – until this Monday, November 13.
This is stated in the text presented in the Congress of Deputies, which proposes amnesty crimes such as usurpation of public offices, embezzlement, disobedience, public disorder and fraudaccording to parliamentary sources.
In this sense, the proposal proposes to exonerate “acts committed with the intention of justifying, promoting or pursuing the secession or independence of Catalonia, as well as acts that would have contributed to the achievement of such ends.”
The text also points out that judges will have to apply the rules preferential and urgent amnesty and that decisions should be made in a maximum period of two months; This does not affect the appeals submitted, which, as indicated, do not have a suspensive effect.
Compliance with the law is not sufficient ‘to resolve the conflict’
The proposal for an amnesty law justifies its need on the grounds that the application of legality is “necessary” but “sometimes not enough to resolve a political conflict that persists over time.” It therefore advocates that the law be adapted to the political context.
Excluding terrorism crimes where there is final conviction and torture
The law excludes forgiveness for terrorist crimes when there has been a final conviction and they have consisted of conduct provided for in the European directive of March 15, 2017, which covers everything from deadly attacks to the possession and manufacture of explosives, as well as torture.
Erase the crimes of a decade and involve the police officers of 1-O
The amnesty law implies the lifting of the “criminal, administrative and accounting responsibility” of all those people involved in the preparation, implementation and consequences of the sovereignty process in Catalonia for a decade, between January 1, 2012 and November 13, 2023.
The amnesty applies not only to the leaders of the ERC and Junts, Oriol Junqueras and Carles Puigdemont, together with the main pro-independence leaders (ministers and deputies), but also to directors of 1-0 schools, mayors, demonstrators and police officers. police officers who acted during the referendum of October 1, 2017.
The arrest warrant for Puigdemont and Rovira in Spain is annulled
It makes a direct reference to former President Carles Puigdemont by noting that “the search and arrest warrants and prison sentences will be null and void”, as will “the national, European and international arrest warrants”, which also affect three other escaped leaders.
This concerns former councilors Antoni Comín and Lluis Puig together with ERC general secretary Marta Rovira. They all had national arrest warrants issued by Supreme Court magistrate Pablo Llarena.
