The Spanish government plans to withdraw the crime of sedition and reduce the maximum prison sentence from 15 to 5 years

PSOE and United We Can have registered the Organic Criminal Code Reform Bill.

Following the announcement yesterday by Pedro Sánchez to reform the crime of sedition, PSOE and United We Can today registered a proposal for an organic law to repeal the current crime of sedition and replace it with another from “aggravated public order”.

The text proposes sanctions of: 3 to 5 years imprisonment and 6 to 8 years disqualification, against 10 to 15 years imprisonment and expulsion from 10 to 15 years established by the current law, according to the organic bill of PSOE and United We Can.

The proposal proposes this reduction after repeal article 544 of the Criminal Code – which defines the crime of sedition – and amend article 557 to create what yesterday the president of the government, Pedro Sánchez, called “aggravated public order”.

PSOE and United We Can underline in the text that “the bad application that until recently experienced the crime of sedition “has prevented a clear understanding of the serious problems of interpretation arising from the difficult delineation of the criminal type and the confusing definition of typical behavior.”

In addition, in the statement a comparison with the law of neighboring countries and the “high severity of the penalties envisaged so far” is indicated in “the criminal law framework within which these crimes move in other European legal systems”. For example, they emphasize that “in other legal systems it is difficult to find a specific crime that can be identified with this offense of sedition of Article 544 of the Criminal Code.”

Both formations argue that it is necessary to suppress the figure of sedition and reform the crime of public disorder. According to the text, this reform aims, among other things, to “provide an adequate criminal justice response to new social phenomena that affect the exercise of legitimate powers by the authorities”.
