After years of research, it is now clear for the second time: Heinrich Schellhorn (Greens) did not exceed his powers by vetoing the expansion of Europark. The public prosecutor has confirmed this.
The investigation into suspected abuse of office against former state representative Heinrich Schellhorn has now been definitively closed. Ricarda Eder of the Salzburg public prosecutor’s office confirms this to the “Krone”. The legal justification for this: “There is no evidence that knowledge is required to abuse authority.”
In other words: Schellhorn did not exceed his authority as a state representative when he decided against the expansion of the Europark in 2021. This is exactly what the Spar Group, the owner of the shopping center, accused him of. In 2022, the Public Prosecution Service stopped the investigation for the first time.
This was followed by a request to continue the business, which was accepted by the court. The Public Prosecution Service filed a complaint against this, failed and started a new investigation. Now these investigations ended with the same result: no indication of criminal liability.
But this should be the final straw now – unless a new application comes along. By the way: Europark is now being expanded – thanks to the black-blue government – anyway.
