The plenary session of the Constitutional Court (TC) has agreed to consider the appeal of the PP against the two amendments that change the system of election and arrival of the two candidates for the TC to be appointed by the General Council for the Case law (CGPJ) has changed; and reject United We Can and PSOE challenges against two magistrates; now enters debate at the request of the PP to urgently suspend consideration of these two amendments in the Senate.
According to the legal sources consulted by Europa Press, both decisions – the admission to trial and the rejection of the challenges against the president of the TC, Pedro González-Trevijano, and the magistrate Antonio Narváez – were passed by 6 votes (that of the conservative majority) versus 5 (those of the progressive minority).
Immediately afterwards, the appearances claimed by UP and PSOE in separate writings were also admitted. And then the magistrates have decided – also by a majority of 6 to 5 – not to accept the challenges of both sides against two magistrates, which raises a technical problem: that the legal-procedural relationship has not yet been established.
The same sources point out that the magistrates are next going to debate the very precautions requested by the People’s Party in its appeal, asking for parliamentary consideration of both amendments, which are already in the Senate, to be halted after they have ended were approved in the Congress of Representatives on Thursday, along with the bill to repeal sedition that included them.
If the TC agrees to these very precautionary measures, it will be an unprecedented situation, as the Court of Warranties has never stopped a debate in the Cortes Generales in its more than 40-year history.
