The Spanish government and the Cortes Generales (Congress and Senate) as representatives of the executive and legislature have abided by the decision of the Constitutional Court (TC) to suspend parliamentary consideration of the amendments that allowed the renewal of the judiciary, although they have expressed concern about an “unusual fact.

After the Constitutional Court reviewed the very precautionary measure – by six votes to five – requested by the PP against the agreements in the bodies of Congress that allowed the incorporation of two amendments into the Penal Code reform to allow the renewal of to enable the TC and the General Council of the Judiciary (CGPJ), the representatives of Congress, the Senate and the Executive issued an institutional statement to review the ruling.

The President of Congress, Meritxell Batet, has confirmed that it adheres to the decision of the Constitutional Court, but has assured that it will defend the autonomy of the legislature in the face of this “unprecedented” event. “We hope to be heard as soon as possible and present our arguments in court to defend parliamentary autonomy,” he said in an institutional statement in the Hall of Lost Steps of the Palace of Congress.

“With the decision known today, the interruption of the exercise of legislative power may come within the reach of a single deputy when appealing against Amparo. concern, from the point of view of the proper functioning of the legislature and the exercise of its constitutional powers,” he stressed.

For his part, the President of the Senate, other screamhas assured that it will comply with the decision, but has warned of the dangers associated with this course of action by the Constitutional Court.

In an institutional statement from the Senate Hall of Lost Steps, Gil has stated that the suspension of the processing of a law presupposes a “serious break” in the democratic system and leads us all to an unprecedented institutional crisis of the state in our democracy .”

He has also highlighted how the Constitutional Court has been subjected to “instrumentalization” by “those who have irresponsibly tried to extract what they cannot extract from the legislative debate before the Chambers” through its “tactical use”.

“What happens today will come at a high cost democratically tomorrow,” also warned the Senate president, who has, however, claimed that democracy is “strong” and has mechanisms to overcome “the worst crises” and he has shown that he is convinced that he will do so now.

“This time we will also succeed in preserving the immunity and constitutional predominance of the Cortes Generales,” he declared after announcing, as has also been done by Congress President Meritxell Batet, that once the constitutional act is complied with, ways to “preserve parliamentary autonomy”.

The Senate decides today how to proceed

Meanwhile, the Senate Council meets this morning to decide whether the reform of the Penal Code, which abolishes the crime of sedition and addresses embezzlement, will proceed without the amendments that have paralyzed the Constitutional Court over the renewal of the court itself.

This body is expected to meet at 08:30, although the time of this meeting depends on the notification to the Senate by the Constitutional Court of the resolution.

For example, the decision on whether or not to continue the consideration in the Senate of the remainder of the bill to reform the Criminal Code now falls to the Senate, where the PSOE and the PP respectively have three members, while the GDP It has one.

Spanish government: the decision is “of maximum seriousness”

The Minister of the Presidency, Court Relations and Democratic Memory, Felix Bolanoshas assured that the resolution of the TC must be respected, but has emphasized that this is something that has never happened in the last 44 years, that it has not happened “in any European country around us” and that it is the foundations of the separation of powers.

In this sense, he has indicated that what happened is of “maximum seriousness” because the TC made the decision in an unusually short time and with a slim majority of six votes instead of five. In addition, he has assured that the Spanish government does not agree with “neither the unusual procedure followed” nor the content of the decision “never seen before in the Cortes Generales”, as he has stressed.

“The law does not give the Constitution the power to paralyze the actions of the Cortes Generales. Moreover, this power existed and was repealed in 1985 precisely to avoid impeding parliamentarians from discussing and approving matters. was to be avoided, it just happened today”, Bolaños lamented.

It has also made the TC ugly that it has “crippled its own renewal” that has been going on for six months and that some magistrates have done it who have “voted their own future,” he added.

On behalf of Unidas Podemos, the Minister of Social Rights, Ion Belarrahas emphasized that “political, media and judicial justice deal an unprecedented blow to democracy”.

Meanwhile, the people’s leader, Alberto Núñez Feijóo, has indicated that “today our democracy is being strengthened”. “In a state of law, all powers are subject to the law. Despite noise and pressure, we will continue to defend Spain and its institutions without fear or concession, out of moderation and reason,” Feijóo claimed. Both Vox and Cs have celebrated the decision, emphasizing that “Sánchez loses”.

Most of Sánchez’s investiture partners, with CKD and PNV at the head they have also regretted the intervention of the TC in the legislature, and More country introduced a bill to reform the Organic Law of the Constitutional Court and avoid delays in the renewal of magistrates.
