The president of the Observatory on Domestic and Gender Violence of the General Council for the Judiciary recalled that any changes would come into effect with the reform itself and that “all of the above should be further reviewed”.
The President of the Observatory on Domestic and Gender Violence of the General Council for the Judiciary (CGPJ), Ángeles Carmona, has assured that changing the sentences in the “only yes is yes” law will not jeopardize consent, unlike to what says the Ministry of Equality headed by Minister Irene Montero.
So, in his opinion, “consent can be maintained” as it is currently contained in the “only yes is yes” law and, in addition, “change the penalty so that, due to legal technique, the penalties are not reduced.”
The President of the Observatory has indicated that this would be the proposal of this body of the CGPJ and of the experts who form it, who, as she indicated, have already called for “a review of the sentence” in their time, so that “hereinafter “They have not included any reduced sentences. In this sense, Carmona recalled that any changes that might be made would come into effect with the reform itself and that “all of the above would have to be reviewed again”.
In an interview with television channel Antena 3, Carmona explained that the spirit of this law, which is to put consent at the center, is already being collected in the jurisdiction of the Supreme Court. This body, as explained by Carmona, “said even before the law that it was not necessary to demand a heroic act from the woman or that there be bodily harm in order to prove a crime against sexual liberty. “
Carmona has also come out in defense of the judges for the statements of several members of Equality, who assert that the problem of the law is one of interpretation. The expert has indicated that Spanish judges are predominantly female and have an average age of 49, in addition to being “perfectly trained and having sensitivity, awareness and respect for this type of crime”.
