After reviewing the ‘trial’ penalty under the penal reform, the Supreme Court has refused to reduce the penalty for embezzlement, upholding the absolute disqualification for Junqueras and Bassa until 2031 and for Romeva and Turull until 2030.

He High Council has condemned Oriol Junqueras, Raul Romeva, Jordi Turull and Dolors Bassa as perpetrators of a crime of disobedience in competition with a crime of misappropriation of public funds. Thus, it has refused to reduce the sentence for the crime of embezzlement imposed by the four, which will expire in the year 2031 in the year 2031 in the case of Junqueras and Bassa, and in the year 2030 in the year 2030 in the case of Turull and Romeva.
On the other hand, the TS has condemned the former presidents of the sovereignist entities ANC and Òmnium Cultural, Jordi Sanchez and Jordi Cuixart, respectively, as perpetrators of a crime of public disorder and Forcadell, Rull and Forn for disobedience. With regard to these five convicts, the entry into force of the 2022 reform determines the total termination of their respective disqualification sentences.
The punishment room High Council has reviewed the judgment rendered on October 14, 2019 in the “trial” case before the Penal Code Reform that repeals the offense of sedition and reformulates the crimes of embezzlement and public disorder, to determine whether the penalty of disqualification imposed on the convicts must be replaced by punishments that the reform associates with the new forms of crime.
The court that issued the order consists of Manuel Marchena (chairman and speaker), Andrés Martínez Arrieta, Juan Ramón Berdugo, Antonio del Moral, Andrés Palomo and Ana Ferrer, who pronounced the verdict of the “trial”.
There is no appeal against this decision.
