“Double knee shot” – Carinthia now wants to sue against “pension robbery”.

Chief of State Peter Kaiser (SPÖ) wants to file a constitutional lawsuit to reverse the pension award, which he calls an “injustice”.

In Carinthia, the election campaign is entering its critical phase. SPÖ governor Peter Kaiser is already touring the country non-stop. “I am currently getting a lot of questions about the pension distribution. Because currently the pension depends on the zodiac sign you were born in.” There is a lot of news about this injustice, but the government is sticking to its plan.

73,000 euros less life pension
The losses as a result of the compensation are enormous: the federal government deducts more than 73,000 euros in life pensions (over 18 years) from all those citizens who retire in November or December 2023 with an average ASVG pension of 2655 gross. With a pension of EUR 1,655 gross, EUR 55,000 in life pension is lost.

The reason for this is the factoring used by the federal government when calculating the pension amount. Accordingly, retirees will receive 100 percent inflation compensation in January. Those unlucky enough not to be born until October will receive 10 percent, and those who retire in November will receive zero percent. This is not a one-off effect, but of course also has a negative effect on future retirement years.

According to Kaiser, the system is a “double shot in the knee – namely in that of retirees and that of the state, in that many prefer to retire earlier because of this arrangement, because the high inflation offset at the beginning of the year means that possible deductions from early retirement are financially much greater than” (see table).

The governor of Carinthia speaks of a “raid in the wallets” of pensioners. He calls for this “injustice” to be corrected. If that does not happen, he would like to file a complaint with the Constitutional Court through a decision of the state government
