EH Bildu denounces that the Ethics Committee does not respect anonymity and that a parliamentarian has been threatened

He accuses the Ethics Commission of “failing to protect the anonymity” of Unai Fernández de Betoño, a person who warned the behavior of a transport officer whose lawyer threatened to take him to court.

EH Bildu has denounced the “irregular functioning” of the Basque government’s public ethics committee, which is accused of having done “nothing” before the “threats” received by MP Unai Fernández de Betoño by the lawyer of a senior transport official who had charged the representative of the sovereign formation before that committee.

EH Bildu has stated that nine days after the Ethics Committee’s representative Transport for insufficient compliance with the code of ethics”, his lawyer sent Fernández de Betoño an email on July 29, 2022 “threatening to take him to court” if he made the Commission’s resolution public.

The Member of Parliament of EH Bildu has confirmed through a statement that the chairman of this committee, the Minister of Public Administration, Olatz Garamendi“knew about these threats from the first moment”, since the department’s lawyer also sent her “a copy” of the above-mentioned e-mail message.

Fernández de Betoño stated that the members of the Ethics Commission “de duty of confidentiality all information handled by that body, including the obligation to ensure the anonymity of complainants”.

In this sense, it stated that “at least in theory” neither the person concerned nor his lawyer “could have known that it was I who had brought his case to the attention of the Commission”. “Clearly the Commission breached that obligation and failed to protect my right to anonymity, allowing the lawyer to address me directly,” he said.

The Sovereignist MP has assured that what happened “shows that the public ethics committee is not properly protecting complainants’ rights”. Given the “seriousness” of the case, EH Bildu has demanded that Garamendi open a file “to identify the member of the Commission who skipped the obligation to preserve the anonymity of the complainants and later release associated responsibilities”.

For his part, MP Josu Estarrona has warned that what happened “calls into question” the functioning and credibility of the public ethics committee, as well as Garamendi’s actions.

After censoring that the adviser “hasn’t even responded in Parliament when asked about it”, Estarrona has announced she will be taking the issue to plenary next Friday. According to EH Bildu’s MP, “It is clear that Garamendi is not fulfilling his duties properly in that committee; and it is also clear that with this way of working Ithe Commission itself is useless“.
