CKDas Junts had previously done, has proposed to be tabled in parliament an appeal of unconstitutionality against the state housing law that he supported in the Congress of Deputies because he believes that “it violates certain powers of the self-government of Catalonia,” as reported in a statement.
The group registered the proposal after the Legal Assurance Council (CGE) issued on Aug. 4 opinion requirement filed by Junts in July: stipulates that several articles and provisions of the standard violate “the exclusive jurisdiction of the Generalitat with regard to housing established by the statute”.
In this way, ERC proposes to appeal against the law to the Constitutional Court (TC) through a resolution proposal that will – textually – follow the recommendations of the CGE to protect the powers of the Generalitat and “destroy the essence of the Housing Law which means very relevant advancements in housing and which are necessary to be able to deploy”.
Specifically, Republicans have proposed challenging five articles and the seventh final provision of the Housing Right Act. However, they claim the value of the approved standard because it was possible “to cap rents or put an end to speculation and abuse that affects citizens”.
For his part, together He is defending an appeal against eight articles, the first and second transitional provision and the seventh final provision of the Housing Right Act.
Both Catalan parties then vote in full on the filing of the appeal 1st of September. The proposal that receives the most votes will ultimately proceed.
