EH Bildu will appeal against the file of the complaint in the Bidegi case

Date:

EH Bildu understands that it is necessary to prepare a third “impartial expert report”, different from the two presented in the case by the parties, with the intention of “covering the additional costs of one million dollars that the liquidation of these works entails’.

EH Bildu has announced that it will appeal to the Gipuzkoa District Court against the filing of one of the two complaints in the so-called Bidegi case by the court investigating the case, and at the same time request an “impartial” expert report . are carried out to “clarify the truth”.

The spokesperson of EH Bildu in the Road Infrastructure Committee of the General Assemblies (JJGG) of Gipuzkoa, Oskar Bordes, made this announcement after a week ago the Court of Instruction Number 2 of Azpeitia provisionally filed one of the two complaints from those in the case .

Both were presented by the Provincial Council of Gipuzkoa, when it was still governed by EH Bildu, by embezzlement of public funds And Forgery of documents related to the construction of the AP-1 highwayand consult the performance of the previous directorwho was chairman Markel Olano (PNV) between 2007 and 2011.

The first of these, still in the investigation phase, concerns a deposit of remains, excavations and earthworks in a section (Eskoriatza Norte-Arrasate Norte) of the AP-1, where the Public Prosecutor calculated an alleged fraud of 13, 6 million euros.

The Provincial Council subsequently filed a second complaint alleging embezzlement of public funds worth €17.1 million and an alleged crime of document forgery in payments for the Isuskitza tunnel works, which have now been archived.

EH Bildu understands that it is necessary to prepare a third “impartial expert report”, different from the two presented in the case by the parties, with the intention of “covering the additional costs of one million dollars that the liquidation of these works entails’.

“At EH Bildu, we believe that the judge has waived certain procedures, including the request and presentation of a third impartial expert report, in addition to the reports issued by the parties,” explains the leader of EH Bildu.

“This is exactly what the Public Prosecutor’s Office has been demanding throughout this process,” stressed Bordes, who recalled how the Public Prosecutor’s Office presented a document on July 2, 2021 in which it highlighted the “extreme complexity and technical nature” of the case and requested that “An independent expert test must be conducted to clarify the reality of the facts.”

According to him, this independent report would make it possible “to determine whether an irregular payment has been made to the construction companies”, since, also according to the Public Prosecutor’s Office, “the expert reports of the parties in conflict showed absolute contradictions.”
