After the furore surrounding an OGH ruling that would have deprived commuters of child benefits, the law has now been improved.
The Supreme Court recently ruled that residents of Vorarlberg who commute to work across the border with Switzerland or Liechtenstein may no longer receive childcare benefits in certain cases. This provision has now been restored with an amendment to the Childcare Allowance Act. This particularly affects all families with their main residence in Austria, where both parents work in Switzerland or Liechtenstein or where only one parent works in Switzerland or Liechtenstein and the other does not work in Austria.
In all these cases, the childcare allowance will be paid again. Families living in Switzerland or Liechtenstein are excluded. The provision will come into effect retroactively from February 1, 2023. Affected families will now also receive financial support retroactively. The OGH decision previously caused a stir.
