Accusation of sedition – proceedings against Westenthaler discontinued

The sedition proceedings against former BZÖ boss and former FPÖ politician Peter Westenthaler have now been legally stopped. The Vienna Supreme Court (OLG) dismissed the prosecutor’s complaint against the first decision. The complaint was filed by the NGO SOS Mitmensch.

The organization accused the former politician of insulting people from Afghanistan “generally and indiscriminately” as “machete murderers.” The statement was made in a TV broadcast on May 3, 2023. Westenthaler defended himself at the time because, as an “independent journalist”, he had criticized the wrong immigration policy in Austria and especially in Vienna. The 55-year-old works for the TV channel oe24.tv and the Austrian daily newspaper.

The complaint from the NGO SOS Mitmensch ended up at the Vienna Regional Court, which ruled that the proceedings should be stopped. However, the Vienna Supreme Court has appealed against this. Westenthaler wrote on Facebook on Wednesday about a ‘political, instruction-bound public prosecutor’s office’. He will now “consider legal action against the chairman of SOS Mitmensch, who publicly made these false accusations against me and reported me.”

Alexander Pollak and Gerlinde Affenzeller share the management of the NGO. Westenthaler’s post on Facebook received 270 likes, was commented on 71 times – only in consultation – and shared 29 times (as of September 27, 7:13 PM).
