Remains Impeccable – In short: diversion for Glatz-Kremsner is legally binding

Now it has been resolved: the diversion for the first defendant in the short trial, Bettina Glatz-Kremsner, is legally binding. As the “Krone” learned, the WKStA has decided not to take legal action. This is particularly remarkable because, in established case law, there is no question of an amicable settlement for declaration offenses.

Just a few days ago it was reported that the former casino boss was still shaking, the distraction was “shaky”. Diversion is the withdrawal from criminal prosecution in exchange for paying a fine or providing community service. This is only possible if the suspect accepts responsibility.

Glatz-Kremsner adopted this on the first day of the trial. This is in contrast to ex-chancellor Sebastian Kurz and his former chief of staff Bernhard Bonelli, who were also accused of false statements in the Ibiza U committee in the case.

WKStA has 14 days from the hiring decision
“I made mistakes,” Glatz-Kremsner said during the trial and was offered a diversionary maneuver by Judge Michael Radasztics, although the WKStA ruled against it “for general preventive reasons.” Sebastian Kurz’s former deputy in the ÖVP had to transfer 104,060 euros before the decision to halt the procedure could be taken. This took place in mid-November. The WKStA then has 14 days to file a complaint, the period ends on Thursday.

Endless procedure prevented
As the “Krone” has learned, the corruption hunters are refraining from legal action. It is therefore clear that the procedure is definitively stopped and that the 61-year-old former manager remains blameless. This is remarkable because, according to established case law, there is no distraction in the case of statement offences.

Radasztics nevertheless exercised his judicial discretion and thus prevented further endless proceedings. “My client is relieved and happy that the procedure has now been completed,” says her lawyer Lukas Kollmann.
