The Supreme Court ordered a retrial after the European Court of Human Rights annulled their sentences of between six and six and a half years in prison, which they had already served.
The plenary session of the Constitutional Court (TC) has agreed to the protection of Arnaldo Otegi, general coordinator of EH Bildu, and has refused to repeat the trial in the Bateragune case against Otegi and four other convicts, according to legal sources cited by EFE .
The TC made the decision with 7 votes from the progressive majority and 4 against from the conservative minority. The Guarantee Court thus confirms Otegi’s appeal against the Supreme Court’s ruling, which ordered a repeat trial after the European Court of Human Rights (ECtHR) annulled his sentences of between 6 and 6.5 years in prison, when it was already fulfilled. .
There are three votes against and four votes in favor of the sentence.
