The Ararteko denounces the Ertzaintza’s “flaws” in investigating “humiliating treatment”

Date:

Manu Lezertua has referred to the problems with accessing recordings made in the police stations, or with “deleting” them once a certain time has passed.

The Ararteko, Manu Lezertua, has denounced the “flaws” that the Ertzaintza has presented for “a long time” in matters such as internal investigations into “degrading” treatment of certain people, problems with access to recordings made in the police stations, or by to “remove” them after a certain amount of time has passed.

Lezertua, who has appeared before the Commission for Human Rights, Equality and Justice of the Basque Parliament to present the report of the institution he heads regarding 2021, has announced that he is considering the possibility of requesting a interview with the security adviser, Josu Erkorekato check “what is your willingness to solve these problems”.

Last year’s report of the Basque Ombudsman-Ararteko mentions the “episodic” complaints received by this institution stating “the difficulties encountered by some people affected by a police action in allowing the recordings of the video cameras on public roads when there is disagreement with the agents, to exercise their legal defence”.

Although this report was already released last March, this Wednesday, in response to questions from the parliamentary groups, the Ararteko delved into these and other issues addressed in the document.

The Ertzaintza has shown “effort” to “examine itself”

In that sense, he has confirmed that the Ertzaintza, like the rest of the police, has shown the “difficulty” it has in “investigating itself”.

Lezertua believes there is a need to investigate “much more in depth” when a person “claims degrading or abusive treatment” by an agent.

The Ararteko has denounced that there “some particularly bloody cases”in which “the attention of the person reporting a sexual assault or assault has been insufficient”.

Lezertua has indicated that it is necessary to know “why” these cases occur, especially given that there are protocols for this and when there are other situations “where the care provided is very good”.

De Ararteko has demanded “that these cases be investigated” and that “they be sanctioned when they need to be punished”.

In addition, he recalled that in 2011, the Basque Ombudsman had already issued a recommendation on “The system of guarantees in police actions and practices”, and regretted that it takes “a long time” to put into practice the guidelines contained in said document.

“Some things are achieved, but there are problems”

“Some things are being achieved, but there are problems,” he said. In this sense, he has stated that the problem of access to recordings in police stations is included in the 2021 report.

Lezertua has stated that this new problem has been added to another about the Ararteko has warned “repeatedly” in recent years, and which refers to the time when these recordings have been preserved. As stated, these video recordings are recorded on previous recordings, so that when a particular recording is requested “it has already been deleted”.

In view of this situation, she has raised the possibility of requesting a specific appearance in Parliament to report or make a general recommendation on this matter.

Likewise, he explained that the first step could be to request a meeting with the security adviser, “to see what his willingness is to correct these deficiencies, which we have long pointed out.”
