The judiciary at its absolute lowest point – this was the title under which the former editor-in-chief of the “Presse”, Andreas Unterberger, wrote as part of his regular online comments:

“The ‘Kurier’ has brought to light a truly scandalous fact. This overshadows all previously known activities of the Zadian judiciary so far. In the events surrounding the disciplinary punishment for the double dereliction of the Kurz prisoner Michael Radasztics, there is an aspect that turns the previously dominant questions into peripheral problems: whether this judge will not declare himself biased in the Kurz trial and whether he has already done so done. At the beginning of the proceedings, he should have made public his disciplinary conviction, which was already legally binding at the time, when Kurz’s lawyers requested that he be dismissed due to his close contacts with Peter Pilz. Now at the latest, a thorough investigation and a high-level dismissal in the legal system is really urgent and necessary. For the first time in a long time, a parliamentary commission of inquiry would actually be justified, in which some actors in this legal system would have to testify truthfully.” (Text contains changes and has been shortened.)

The comment, the link of which could be found on krone.at, claims the following, with a number of points:

“1. According to the verdict, an exchange took place between Radasztics and Pilz outside the usual witness examination. But its content was never made known.”

“2. Pilz even asked a parliamentary question based on the information from Radasztics.”

In fact, no meeting and no ‘exchange’ took place about the content of the criminal proceedings.

The basis for the parliamentary question was research before Pilz was questioned by STA Radasztics on December 20, 2018; in the conversation, the prosecutor only reported an instruction to return the files, which Pilz was already aware of. Peter Pilz wrote this to krone.at.

You can also read in Mr. Unterberger’s comment:

“9. According to – albeit only confidential – statements from judicial officials, Pilz was Zadic’s guest at the ministry several times, while Zadic had actually switched to another party.”

Here too, no meeting took place between Pilz and Justice Minister Zadic, as is also evident from the letter from Peter Pilz to krone.at.
