However, the Supreme Court admits the request for protection of several PP deputies, and will therefore review the decision of the Parliament’s Age Council, which accepted the delegated vote.
The plenary meeting of Supreme Court (TC) has refused to suspend for the time being the agreement on the age table of the Catalan parliament, with which the delegate vote both former president Carles Puigdemont and former councilor Lluís Puig – both elected but exiled deputies – for the election of the bodies of the Chamber, the president and the members of the council.
According to legal sources, the decision was adopted with a vote against conservative magistrates Enrique Arnaldo and Concepción Espejel, and within the framework of the admission to the hearing of the appeal of parliamentary protection filed by several deputies of the PP of Catalonia against that decision of the Parliamentary Council. The argument of the PP is that the acceptance of these two delegated votes is contrary to the criteria of the Constitutional Court, which just two weeks ago confirmed an appeal by PSC-Units against the agreements of the parliamentary council that allowed the telematic vote of former councilor Lluís Puig in the previous parliamentary term.
The magistrates concluded that the fact that he is “voluntarily” outside Catalonia because “he has decided to circumvent the action of the Spanish criminal justice system” cannot be considered a “constitutionally valid circumstance” for telematic voting. And they also reminded that Puig is “subject to a search and arrest warrant.”
