The TC supports that people between 16 and 17 years old can have an abortion without family consent

Date:

In addition, the Guarantee Court has established public hospitals as centers where this abortion can be performed.

The Constitutional Court approved the ruling reform of the abortion law that allows people between the ages of 16 and 17 to terminate a pregnancy without family consent. Furthermore, she determines to perform the aforementioned abortion public hospitals as centers to perform this function.

Therefore, the Court of Guarantees rejected Vox’s appeal against Law 1/2023 on Sexual and Reproductive Health and Voluntary Termination of Pregnancy, which amended the law approved in 2010, with seven votes in favor of the progressive majority and four against.

The formation led by Santiago Abascal brought the law before the Constitutional Court, ruling that it violated the principles of freedom, plurality and legality, and the right to life, equality and ideological freedom.

However, it was judges Concepción Espejel, Enrique Arnaldo, César Tolosa and Ricardo Enríquez who used their private votes against the majority decision.

Reform

In February 2023, Congress finally approved the reform that gave minors between the ages of 16 and 17 the right to abortion, without the need for consent from their relatives or legal guardians. Article suppressed by Mariano Rajoy’s government in 2015.
