Judge of the National Supreme Court Manuel García Castellón has refused to sue Iberdrola as a legal person in the case examining the electricity company’s relationship with companies linked to former police commissioner José Manuel Villarejo, in which its renewable energy subsidiary is already appearing as a defendant.
In a car from this Friday, the head of the central court of instruction number 6 dismisses the request from the President of ACS, Florentino Pérezamong others in this sense.
The magistrate explains that it would result”not just unfounded, but disproportionate and it could lead to ultimate strict liability, requiring the parent company to monitor all actions of its subsidiary to try to prevent the commission of crimes when it is an action of its own and exclusive to the subsidiary.”
On May 26, Pérez reiterated the request to the magistrate to sue the company, as he had already done in February 2020, based on certain notes in Villarejo’s diary that allegedly the former commissioner was hired by Iberdrola to spy on him
